04 ZarpOS and Client Data
When clients use ZarpOS, the Contractor Portal, or services we run for them (such as websites, lead forms, CRM, scheduling, payments, email and SMS automations, and ad campaigns), we process information about their own customers and leads, such as names, contact details, service requests, appointments, invoices, payments, and messages ("Client Data").
We process Client Data on behalf of our clients and under their instructions, to provide, secure, support, and improve the Services. Each client is responsible for its own privacy notice and for obtaining the consents required to collect Client Data and contact its customers. If you are a customer of one of our clients and have a question about your information, please contact that business directly; we will help them respond.
We also record activity in ZarpOS and the Contractor Portal, such as sign-ins, devices, and actions taken, to operate the software, support clients, and keep accounts secure.
05 Confidential Business Information
We treat our clients' trade secrets, patents and inventions, and operational and financial information, including the financial, project, invoice, and payment records kept in ZarpOS and the Contractor Portal, as Confidential Information under our Terms of Service. We use commercially reasonable measures to protect it and use it only to provide, secure, and support the Services for that client.
Client Confidential Information and Client Data are excluded from the information we share with marketing and business partners (Section 9).
06 Google User Data
Some of our applications, including ZarpOS, can connect to a Google Account when you authorize them through Google's sign-in and consent screen. They request only the access needed for the features you use, and Google shows you what access you are granting before you approve it.
Google API Services User Data Policy
ZarpOS's use and transfer to any other app of information received from Google APIs will adhere to the Google API Services User Data Policy, including the Limited Use requirements. The same applies to every other Zarp Studio application that accesses Google user data.
For information received from Google APIs ("Google user data"):
- We use it only to provide and improve the user-facing features you authorized.
- We do not transfer it to others, except as needed to provide or improve those features, for security purposes, to comply with applicable law, or as part of a merger, acquisition, or sale of assets after obtaining your explicit prior consent.
- We do not use it, transfer it, or sell it for advertising, including retargeting or interest-based advertising, and we do not transfer or sell it to advertising platforms, data brokers, or information resellers.
- We do not use it to develop, improve, or train generalized artificial intelligence or machine learning models.
- Our team members do not read it unless you give us permission for specific data, it is necessary for security purposes or to comply with applicable law, or the data is aggregated and anonymized for internal operations.
You can revoke an application's access at any time on your Google Account permissions page and ask us to delete Google user data we hold by writing to [email protected].
07 Emails, Calls, and Text Messages
If you share your email address or phone number, we may contact you by email, phone call, text message, or WhatsApp about your inquiry, proposal, account, projects, reports, or billing.
- Marketing text messages are sent only with your consent, which is never required to buy.
- You can unsubscribe from marketing emails using the link in the message, reply STOP to any text message, or write to [email protected].
- Message and data rates may apply. Message frequency varies.
- The details of our text messaging program, including HELP and STOP, are in our Terms of Service.
Mobile phone numbers, text messaging opt-in data, and consent collected for our text messaging program are not shared with third parties or affiliates for their marketing or promotional purposes (see Section 9).
08 How We Share Information
We share personal information with the following categories of recipients, for the purposes described in this policy:
- Service providers that process information on our behalf, such as website and software hosting, databases, email, phone and text messaging, scheduling, CRM, customer support, AI, and analytics providers.
- Payment processors, to process payments, invoices, refunds, and payouts.
- Advertising and search platforms, such as Google and Meta, when a client runs campaigns or listings with us and when we advertise our own services, for example to deliver ads, measure conversions, and manage audiences.
- Marketing and business partners, with your authorization, as described in Section 9.
- Referral partners, to confirm whether a business they referred became a client and to calculate their commission.
- Our clients, for Client Data we process on their behalf.
- Professional advisers, such as lawyers, accountants, and auditors.
- Legal and safety recipients, such as authorities and courts, when required by law or needed to protect our rights, property, clients, or others, including in legal proceedings.
- Business transfers: a buyer, investor, successor, or other party in connection with a merger, acquisition, financing, reorganization, or sale of all or part of our business or assets, including during due diligence.
- Others, with your consent or at your direction.
Google user data is shared only as described in Section 6, and text messaging data only as described in Section 9. Information you post in public places, such as reviews or public comments, may be visible to others.
09 Marketing and Business Partners
We work with marketing and business partners, such as companies whose products and services may interest home service businesses. With your consent or authorization, which you give, for example, when you opt in or submit a form where we ask for it, or when you use Services that involve a partner, we may share and exchange with those partners:
- Contact information, such as your name, business name, email address, business phone number, and business address
- Marketing information, such as your business category, service area, company size, and the services you are interested in
Partners may use this information to offer you their own products and services, under their own privacy policies. We may also receive similar information about you from them.
What we never share with partners
- Text messaging data. Mobile phone numbers, text messaging opt-in data, and consent collected for our text messaging program are not shared with third parties or affiliates for their marketing or promotional purposes. No category of sharing in this policy includes this information, except sharing with the service providers that deliver our text messages (such as messaging platforms, aggregators, and carriers), only to deliver them, and a business transfer, after which the information stays subject to this commitment.
- Client Confidential Information and Client Data, described in Section 4 and Section 5.
Withdrawing your authorization
You can withdraw your authorization at any time by writing to [email protected] or calling +1 (321) 333-2825. We will stop sharing your information with partners going forward within a reasonable time. Information already shared is governed by the partner's own policy, so please contact the partner directly to stop its messages. Where the law treats this sharing as a "sale" or "sharing" of personal information, you can also opt out as described in Section 13.
11 Data Retention
We keep personal information for as long as needed for the purposes in this policy: while you are a prospect, client, or partner, and afterward for as long as needed to keep business, tax, and accounting records, resolve disputes, and enforce our agreements, or as required by law.
We keep Client Data while the client's account is active and as the client instructs, and delete or return it within a reasonable time after the engagement ends, unless the law requires us to keep it longer. When information is no longer needed, we delete or anonymize it.
12 Data Security
We use reasonable administrative, technical, and physical measures designed to protect personal information, such as encrypted connections (HTTPS) and access controls.
No method of transmission or storage is 100% secure, so we cannot guarantee the security of your information.
You can help by giving us user-level access to your accounts instead of sharing passwords, keeping your Contractor Portal password private, and telling us right away about any unauthorized use. To the maximum extent permitted by applicable law, our liability for any matter related to this Privacy Policy is limited as described in our Terms of Service.
13 Your Rights and Choices
Depending on where you live, and subject to applicable law, including U.S. state privacy laws where they apply, you may have the right to:
- Know about and access the personal information we hold about you
- Correct inaccurate information
- Delete your information, subject to legal exceptions
- Receive a copy of your information in a portable format
- Opt out of marketing messages, targeted advertising, and the sale or sharing of personal information, as those terms are defined by law
- Withdraw consent you gave us, without affecting processing that happened before
To make a request, email [email protected] or call +1 (321) 333-2825. We will verify your identity before acting and respond within the time required by applicable law. Where the law allows, you may use an authorized agent, and if we decline your request, you may appeal by replying to our decision. Deleting your information may end your access to ZarpOS and the Contractor Portal. We will not discriminate against you for exercising your rights.
If we hold your information as Client Data on behalf of one of our clients, we will refer your request to that client or help them respond.
14 Children's Privacy
Our website and Services are intended for businesses and adults 18 and older, not for children. We do not knowingly collect personal information from children under 13. If you believe a child has given us information, contact us and we will delete it.
15 Third-Party Links
Our website and software link to services we do not control, such as Google, Meta, WhatsApp, social networks, and the websites of clients in our portfolio. Their privacy practices are governed by their own policies.
16 Users Outside the United States
We are based in Florida, and our Services are intended for businesses in the United States. If you use them from elsewhere, your information will be processed in the United States and in other countries where our team members and service providers work, which may have different data protection laws.
Where laws such as Brazil's General Data Protection Law (LGPD) or the EU or UK GDPR apply, we process personal information to perform our contracts, for our legitimate interests in running and growing our business, with your consent, or to comply with legal obligations. You may have additional rights under those laws, including to object to processing and to complain to your data protection authority.
17 Changes to This Policy
We may update this Privacy Policy at any time. Changes take effect when posted on this page, and the "Last updated" date at the top shows when it last changed. If we make significant changes, we may also tell you through the website, the Contractor Portal, or by email.
